End-User License Agreement (EULA) for Using www.taxcontaindia.com and Associated Mobile Applications

This End-User License Agreement (EULA) is a legally binding agreement between you (the “User,” either an individual or a single entity/organization) and ESCONTA TECHNOLOGIES PVT. LTD. (“ESCONTA”), regarding the use of the website www.taxcontaindia.com and its associated mobile applications (collectively, the “Product/Service”). These applications may include, but are not limited to, ones for tax research, tax practice, or accessing the TaxContaIndia store.

Acceptance of Terms: By accessing, installing, copying, or otherwise using the Product, you agree to be unconditionally bound by the terms of this EULA. If you disagree with the terms, you may not use or access the Product.

Grant of License

ESCONTA grants you a revocable, non-exclusive, non-transferable, limited license to access and use the Product/Service solely for your personal or internal business purposes, subject to the terms of this EULA. All rights not expressly granted herein are reserved by ESCONTA.

Account Registration and Data Privacy

To access certain features of the Product, you may need to register an account. You are solely responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

ESCONTA is committed to processing personal data in accordance with applicable data protection laws, ensuring the protection and confidentiality of your data. By using the Product/Service, you consent to ESCONTA’s use of your data in accordance with ESCONTAs Privacy Policy, including for promotional purposes. You acknowledge that your rights to cancel the service and request refunds are subject to ESCONTA’s cancellation and refund policies.

Use Restrictions

You agree not to use the Product beyond the scope of the license granted under this EULA. You may not sublicense, sell, rent, lease, distribute, copy, modify, reverse engineer, decompile, disassemble, or create derivative works of the Product or otherwise attempt to access the source code.

The Product may not be used in any manner that could damage, disable, overburden, or impair any ESCONTA server or the network(s) connected to any ESCONTA server or interfere with any other party’s use and enjoyment of the Product.

Intellectual Property

All rights, title, and interest in and to the Product, including all associated intellectual property rights, are owned by ESCONTA or its licensors. You are granted no rights or licenses to the intellectual property of the Product other than the limited license to use the Product as provided under this EULA.

No part of the information available on the product may be reproduced or copied in any form or by any means without the written permission of ESCONTA. This includes graphic, electronic, or mechanical methods such as printing, photocopying, recording, taping, or storing information on any disc, tape, perforated media, or other storage device. All disputes are subject to Gurgaon jurisdiction only.

Compliance with Laws

You agree to use the Product/Service in compliance with all applicable laws, regulations, and guidelines.

Termination

ESCONTA reserves the right to terminate this EULA and your access to the Product/Service at any time and for any reason, including but not limited to a breach of this EULA. Upon termination, you must immediately cease all use of the Product and destroy all copies, full or partial, of the Product/Service.

Disclaimer and Limitation of Liability

While ESCONTA strives to ensure accuracy, errors or omissions may occur in the products/subscriptions. ESCONTA recommends consulting original government publications or notifications for verification and disclaims any liability for damages arising from such errors.

ESCONTA makes no warranties or representations regarding the accuracy, content, or performance of the products. The products are provided “as is” and to the maximum extent permitted by law. ESCONTA disclaims all warranties and conditions, express or implied, including those of merchantability, fitness for a particular purpose, and non-infringement.

Governing Law and Jurisdiction

This EULA shall be governed by and construed in accordance with the laws of India, without giving effect to any principles of conflicts
